[93] For Indiana, no statute or regulation requires any correctional centers or juvenile detention centers to offer any vaccines to any inmates/juveniles or to ensure that any inmates/juveniles are vaccinated with any vaccines. However, note Ind. Admin. Code tit. 470, r. 3-11-75, relating to “child caring institutions.” Ind. Admin. Code tit. 470, r. 3-11-75 requires that the child caring institution shall ensure that each child has received immunizations and boosters required by the State Board of Health, and that every child must be immunized against routine childhood illnesses. “Child caring institutions” are defined in Ind. Admin. Code tit. 470, r. 3-15-5 as a place engaged in (among other things) receiving and caring for delinquent children. However, according to Indiana state counsel, child caring institutions operated by the Department of Corrections, county jails, and detention centers are not covered by the statute affected, Ind. Code tit. 470, r. 3-11-75 requires that the child caring institution, after attempting to determine the child’s immunization status, ensures that each child has received immunizations and boosters required by the State Board of Health, and that every child must be immunized against routine childhood disease. “Child caring institutions” are defined in Ind. Admin. Code tit. 470, r. 3-15-5 as place engaged in (among other things) receiving and caring for dependent children, children in need of services, or delinquent children. Based on the identity of those children served, this chart assumes that the definition of “child caring institutions” includes facilities serving developmentally disabled or mentally retarded children.
