2009 H1N1 Flu Legal Preparedness
The outbreak of A/H1N1 "swine flu" in the United States and countries around the world has triggered public health emergency legal responses in many jurisdictions. Please visit this page regularly for current information about legal actions and other relevant legal information as it becomes available.
The Association of State and Territorial Health Officials (ASTHO) and the National Association of County and City Health Officials (NACCHO), funded by CDC's Office of Public Health Preparedness and Response, have completed assessments of legal and other policy barriers, encountered by public health officials responding to the influenza A(H1N1) epidemic. The final reports include findings about the extent to which policies inhibited response and about specific federal, state, and local policies that could be addressed to improve the public health response to future events. The reports also suggest promising practices and opportunities for additional federal, state, and local collaboration to improve or address policies that influence public health response. The ASTHO report is posted at http://www.astho.org/Programs/Infectious-Disease/H1N1/ and the NACCHO report is posted at http://www.naccho.org/topics/H1N1/index.cfm.

To assist in mass administration of H1N1 vaccine, states are evaluating their laws to determine individuals who are authorized to administer H1N1 vaccines. If necessary, states are amending legal provisions to extend legal authority to administer HlNl vaccine to persons who would not otherwise be permitted to administer vaccine. Three states provide examples:
Massachusetts emergency regulation passed recently by the Public Health Council (to be effective upon filing with the Secretary of State) authorizing the Commissioner of Public Health to issue an order designating the persons who may administer H1N1 vaccine and the conditions under which the vaccine may be administered. To access the regulation, 105 CMR 700.003(H), please click here.
Michigan statute authorizing physicians to delegate administration of vaccine to appropriately trained individuals. To access the statute, MCL 333.16215, please click here.
Recently-amended Minnesota statute extending the authority of the Commissioner of Health to respond to requests of local officials by expanding the categories of persons authorized to administer vaccine. To access Minnesota Statutes section 144.4197 (2008) as amended by Minnesota Laws 2009, chapter 41, section 5, please click here.
